Family Terms Conditions

Contracting entity / Controller: Beamly Pte. Ltd., Singapore (“Beamly”, “we”, “us”, “our”).

1) What this covers

These Terms govern your use of the Beamly Family App and related services that help parents/guardians and schools screen and monitor early developmental progress. By creating an account or using the App, you agree to these Terms.

2) Key definitions

  • Parent/Guardian: The legal parent or person with authority over the child user.

  • Child: A minor whose profile you create and manage.

  • Organization: An organization or professional you authorize to access your child’s profile for screening.

  • Screening: Non-diagnostic developmental screening and learning-insight activities done with the Beamly Screening App.

3) What Beamly provides

  • Tools for you to create and manage your child’s profile.

  • A consent workflow to let you share your child’s data with selected organizations.

  • Screening and insights that help track developmental progress and inform teaching strategies.

  • Secure storage and processing of data and delivery of reports back to you.

Important: Beamly does not provide medical care or clinical diagnosis. Our tools offer educational guidance and early developmental insights only. Always seek advice from qualified health professionals for diagnosis or treatment decisions.

4) Your responsibilities

You confirm that:

  • You are the child’s legal parent/guardian and have authority to give consent.

  • Information you provide is accurate and kept up to date.

  • You will use the App for lawful purposes and in line with these Terms.

  • You control which organizations can access your child’s profile and can revoke access at any time in the App.

  • You will keep account credentials secure and notify us of suspected misuse.

5) Consent and data use

You give Beamly and your authorized organizations permission to collect, access, store, use, and analyze your child’s screening data to provide the services. You can withdraw consent or change sharing settings at any time in the App. Withdrawal does not affect processing already performed under valid consent.

6) Your rights over your child’s data

You can, subject to applicable law:

  • View screening results and profile information.

  • Correct inaccurate data.

  • Delete your child’s profile and request data deletion (some records may be retained as required by law, security, or dispute resolution—see Privacy Policy).

  • Export data where technically feasible.
    How to exercise: Use in-App controls or contact our Data Protection Officer (DPO) in the Privacy Policy.

7) Data ownership and license

Your child’s data belongs to your family. You grant Beamly a limited, revocable license to host, process, analyze, and back up the data to operate, secure, and improve the services. We may use anonymized and aggregated data for research, analytics, and product improvement. We will not attempt to re-identify anonymized data.

8) Organizations

When you authorize a organizations, you instruct us to share the necessary data with them. They may have their own terms and privacy notices. Beamly is not responsible for how organizations use data outside our documented services. You can revoke their access at any time.

9) Acceptable use

Do not: misuse the App, attempt to access others’ data, upload unlawful content, reverse engineer, or interfere with security. We may suspend or terminate accounts that violate these Terms or applicable law.

10) Intellectual property

Beamly owns the App and underlying IP. You receive a personal, non-transferable, revocable right to use the App in accordance with these Terms.

11) Service changes and availability

We may update features, interfaces, or policies. We aim for high availability but do not guarantee uninterrupted service. Planned significant changes will be notified in-App or by email.

12) Disclaimers

The services are provided “as is”. Beamly disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent permitted by law. Screening outputs are educational insights only and should not be the sole basis for medical, clinical, or high-stakes decisions.

13) Limitation of liability

To the extent permitted by law, Beamly will not be liable for: loss of profits, loss of data (beyond obligations in the Privacy Policy), or indirect/consequential damages. Our total aggregate liability arising out of or related to the services is limited to the higher of: (a) SGD 1,000 or (b) the total fees you paid to Beamly in the 12 months before the event. Nothing limits liability for fraud, death or personal injury caused by negligence, or other liabilities that cannot be excluded by law.

14) Indemnity

You agree to indemnify Beamly from third-party claims arising from your unlawful use of the App or breach of these Terms.

15) Termination

You may stop using the App and request deletion at any time. We may suspend or terminate for breach, security risk, legal requirement, or discontinuation of the service. Effects of termination are described in the Privacy Policy (retention and deletion).

16) Governing law and disputes

  • If your primary residence is in Singapore: Singapore law governs; courts of Singapore have exclusive jurisdiction.

  • Malaysia: Malaysian law governs; courts of Malaysia have jurisdiction.

  • Philippines: Philippine law governs; courts of the Philippines have jurisdiction.

  • Australia/UK/other: Local mandatory consumer/data laws apply; default governing law is Singapore unless prohibited.
    Good-faith resolution first: Contact our DPO. If unresolved within 30 days, parties may agree to mediation (e.g., SIMC) before litigation. Nothing limits your right to lodge complaints with your local data protection authority.
